Terms and Conditions for Waste Removal Marylebone

These Terms and Conditions set out the basis on which Waste Removal Marylebone provides waste collection and related services to customers. By making a booking, confirming a collection, or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for waste removal services.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, landlord, managing agent, organisation or other party who requests or receives waste removal services from Waste Removal Marylebone.

Services means any waste removal, waste collection, rubbish clearance, bulky item removal, recycling, loading, transportation, or related services supplied by Waste Removal Marylebone to the Customer.

Waste means the items, materials, rubbish, junk, debris or other goods that the Customer asks Waste Removal Marylebone to remove, collect or transport.

Agreement means the contract between Waste Removal Marylebone and the Customer for the supply of Services in accordance with these Terms and Conditions, together with any written quotation or confirmation issued by Waste Removal Marylebone.

Site means the property, building, premises or location at which the Services are to be provided, including any access routes, driveways or shared spaces used during the provision of the Services.

2. Scope of Services

Waste Removal Marylebone provides waste collection and removal services for domestic, commercial and light construction customers. Services may include household waste clearance, office waste removal, garden waste collection, bulky item disposal and recycling collections, subject to availability and compliance with relevant waste regulations.

The exact scope of Services will be agreed with the Customer at the time of booking or as set out in a written quotation or confirmation. Only Waste expressly agreed at the time of booking, or as subsequently agreed with our operatives on arrival, will be removed. Additional waste may be collected at the discretion of the operative and may incur extra charges.

3. Booking Process

3.1 A booking may be made by telephone, email or through an online enquiry or booking form, where available. The Customer must provide accurate information regarding the type, approximate volume and location of the Waste, as well as any access restrictions or special requirements at the Site.

3.2 Any quotation given before a site visit is based on the information provided by the Customer and is indicative only. Waste Removal Marylebone reserves the right to amend the quotation upon arrival if the actual volume, weight, type of Waste, or access conditions differ from those described in the initial enquiry.

3.3 A booking is only confirmed when Waste Removal Marylebone issues a confirmation by email, text message or verbally and an agreed date and time window for the Service has been provided. Waste Removal Marylebone may refuse a booking at its absolute discretion.

3.4 The Customer must ensure that someone authorised is present at the Site at the agreed time to provide access, confirm the Waste to be removed and approve any amendments to the quotation. If no one is present, Waste Removal Marylebone may, at its discretion, proceed with the removal based on prior instructions or treat the booking as a failed collection which may incur a charge.

4. Access and Service Conditions

4.1 The Customer is responsible for providing safe, adequate and lawful access to the Site for our vehicles and operatives. Any relevant parking arrangements, permits, permissions or access instructions must be arranged by the Customer in advance.

4.2 If our team is unable to gain access to the Site at the agreed time, or if access is unsafe or severely restricted, Waste Removal Marylebone may cancel or rearrange the booking and may charge a call-out or waiting fee.

4.3 The Customer must ensure that the Waste is clearly identified and separated from items that are not to be removed. Waste Removal Marylebone accepts no liability for the removal of items that were not clearly indicated as being excluded from the collection.

4.4 Waste may be collected from internal areas, external areas, basements, lofts or upper floors at our discretion, subject to health and safety considerations. Additional charges may apply where collection requires significant manual handling, dismantling or extended loading time.

5. Waste Types and Regulations

5.1 Waste Removal Marylebone operates in accordance with applicable UK waste management legislation, duty of care requirements and environmental regulations. All collected Waste will be transported and disposed of or recycled at licensed facilities wherever possible.

5.2 The Customer is responsible for informing Waste Removal Marylebone of any hazardous, controlled or specialist Waste, including but not limited to chemicals, solvents, oils, asbestos, clinical waste, batteries, gas cylinders, tyres and electrical equipment subject to specific disposal rules. Hazardous or specialist Waste may be refused or may incur additional charges and special handling procedures.

5.3 Waste Removal Marylebone reserves the right to refuse the collection of any Waste that is deemed unsafe, unlawful, incorrectly described, excessively heavy, contaminated, or not in compliance with relevant waste regulations.

5.4 The Customer warrants that they have full authority to request the removal of the Waste and that the Waste is not stolen, unlawfully obtained or subject to any dispute. The Customer shall indemnify Waste Removal Marylebone against any claims or losses arising from breaches of this warranty.

6. Pricing, Quotations and Payments

6.1 Prices are usually based on the volume and type of Waste, loading time, labour required, access conditions and any additional services requested. Price information may be provided in the form of a price guide or specific quotation.

6.2 Any quotation provided before the collection is an estimate and may be revised on site once our operatives have inspected the Waste and access. The operative will confirm the final price with the Customer before proceeding. If the Customer does not agree to the revised price, the collection may be cancelled and a call-out fee may be charged.

6.3 Unless otherwise agreed in writing, payment is due on completion of the Service and must be made before our operatives leave the Site. Waste Removal Marylebone accepts payment by cash, card or bank transfer, subject to the payment methods offered at the time of service.

6.4 For business customers, account facilities or invoicing terms may be offered at the discretion of Waste Removal Marylebone. Where credit terms are agreed, invoices are payable within the timeframe specified on the invoice. Waste Removal Marylebone reserves the right to charge interest and recovery costs on overdue amounts in accordance with applicable legislation.

6.5 All prices are exclusive of any applicable taxes unless otherwise stated. If the rate of tax changes between the date of booking and the date of supply, the applicable rate at the date of supply will apply.

7. Cancellations, Amendments and Waiting Time

7.1 The Customer may cancel or amend a booking by giving as much notice as reasonably possible. Cancellations or significant changes made with less than 24 hours' notice may incur a cancellation fee at the discretion of Waste Removal Marylebone.

7.2 If our operatives arrive at the Site within the agreed time window and are unable to carry out the Service due to lack of access, absence of the Customer or their representative, or other circumstances within the Customer's control, Waste Removal Marylebone may charge a call-out fee and any waiting time.

7.3 If Waste Removal Marylebone needs to cancel or reschedule a booking due to vehicle breakdown, staff illness, adverse weather, traffic disruption or other events beyond our reasonable control, we will notify the Customer as soon as practicable and offer a new collection time. Waste Removal Marylebone shall not be liable for any loss arising from such cancellation or rescheduling.

7.4 Where the Customer requests additional services on the day of collection, our ability to provide such additional services will depend on scheduling and capacity. Additional charges will apply and will be agreed on site before the work is carried out.

8. Customer Obligations

8.1 The Customer agrees to provide accurate information about the Waste and the Site, and to notify Waste Removal Marylebone of any known risks, hazards or access issues, including narrow streets, restricted parking, low ceilings, fragile surfaces, or items requiring dismantling.

8.2 The Customer is responsible for ensuring that all necessary permissions have been obtained from landlords, neighbours, building managers or other relevant parties for the removal of Waste and for vehicle access.

8.3 The Customer shall not ask our operatives to carry out any work that is unsafe, unlawful, or outside the agreed scope of the Services. Our operatives may refuse any request that they consider to be unsafe or not covered by these Terms and Conditions.

8.4 The Customer must keep children, pets and other persons away from the working area while the Services are being carried out, and must take reasonable steps to ensure safety at the Site.

9. Liability and Limitations

9.1 Waste Removal Marylebone will exercise reasonable care and skill in providing the Services. However, the Customer acknowledges that minor scuffs, marks or wear may sometimes occur when moving heavy or bulky items through tight spaces. The Customer should take steps to protect floors, walls and fixtures if they are particularly concerned about potential damage.

9.2 Waste Removal Marylebone shall not be liable for any loss, damage, cost or expense arising from inaccurate information supplied by the Customer, from failure to obtain necessary permissions, or from the hazardous nature of the Waste that was not disclosed in advance.

9.3 Nothing in these Terms and Conditions limits or excludes Waste Removal Marylebone's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

9.4 Subject to the above, Waste Removal Marylebone shall not be liable for any loss of profit, loss of business, loss of goodwill or any indirect or consequential loss arising out of or in connection with the Services or these Terms and Conditions.

9.5 Waste Removal Marylebone's total liability for any claim arising out of or in connection with the Agreement, whether in contract, tort or otherwise, shall be limited to the total fees paid or payable by the Customer for the specific Service giving rise to the claim.

10. Insurance

10.1 Waste Removal Marylebone maintains public liability insurance and, where required, employer's liability insurance at levels appropriate to the nature of our Services.

10.2 Evidence of insurance cover can be made available upon reasonable request. Insurance is provided subject to the terms, conditions and exclusions of the relevant policy.

11. Complaints and Service Issues

11.1 If the Customer is dissatisfied with any aspect of the Service, they should notify Waste Removal Marylebone as soon as possible, ideally within 24 hours of the collection, providing full details and any supporting information.

11.2 Waste Removal Marylebone will investigate the complaint and may request additional information or photographs. Where appropriate, we may offer a partial refund, a re-visit or other remedy at our discretion.

11.3 Making a complaint does not entitle the Customer to withhold payment of invoices that are otherwise due, unless expressly agreed by Waste Removal Marylebone in writing.

12. Data Protection and Privacy

12.1 Waste Removal Marylebone may collect and process personal data such as names, contact details, addresses and payment information for the purposes of booking, delivering and administering the Services.

12.2 Personal data will be processed in accordance with applicable data protection laws. Information may be shared with employees, contractors, insurers and service providers where reasonably necessary to deliver the Services or manage our business.

12.3 The Customer is responsible for ensuring that any personal data provided to Waste Removal Marylebone in connection with third parties, such as tenants or occupants, has been provided lawfully.

13. Intellectual Property

13.1 All rights in any materials, branding, logos or documentation produced or provided by Waste Removal Marylebone in connection with the Services remain the property of Waste Removal Marylebone or its licensors.

13.2 The Customer may not reproduce or use any such materials for purposes beyond the normal use of the Services without prior written consent.

14. Termination

14.1 Waste Removal Marylebone may terminate or suspend the Agreement with immediate effect by giving written or verbal notice to the Customer if the Customer commits a material breach of these Terms and Conditions, fails to pay any amount due, or behaves in an abusive, threatening or unsafe manner towards our operatives.

14.2 On termination, any sums owed by the Customer become immediately payable. Termination shall not affect any rights or remedies that have accrued prior to the date of termination.

15. Events Beyond Our Control

15.1 Waste Removal Marylebone shall not be in breach of these Terms and Conditions or liable for any delay or failure in performing its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control, including but not limited to extreme weather, traffic disruption, accidents, strikes, civil disturbances or failure of utilities.

15.2 In such circumstances, Waste Removal Marylebone may suspend the Services for the duration of the event or offer an alternative collection date.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.

17. General Provisions

17.1 These Terms and Conditions constitute the entire agreement between Waste Removal Marylebone and the Customer in relation to the Services and supersede any prior understandings, assurances or representations, whether oral or written.

17.2 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. The remaining provisions shall continue in full force and effect.

17.3 No failure or delay by Waste Removal Marylebone to exercise any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

17.4 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of Waste Removal Marylebone. Waste Removal Marylebone may assign or subcontract its rights and obligations at any time, provided that this does not materially reduce the level of Service provided to the Customer.

17.5 Any notices or communications in relation to these Terms and Conditions may be given verbally, by email, text message or post, using the contact details last provided by the parties.

By proceeding with a booking or allowing our operatives to commence work, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions for waste removal and collection services.
